1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Cobain AIwebsite, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Description of Service
Cobain AI is an AI productivity platform that provides access to a suite of AI-powered tools, including AI chat, content and copywriting, code generation, image and logo generation, translation, and document tools. The Service is offered on a subscription basis together with consumable token credits. We may add, modify, or discontinue features at any time.
3. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
4. Subscriptions, Plans & Token Credits
The Service is offered through subscription plans and/or token credits. Subscription plans provide access to features for a recurring period, and token credits are consumable units used to access certain AI tools. Token credits that have been consumed are used and are not restored. Plan features, limits, token allowances, and pricing are described at the point of purchase and may change prospectively.
5. Billing & Payments
Our order process and payments are conducted through our third-party payment providers (such as Tripay and PayPal). Cobain AI is the seller of record for all purchases made through the Service and handles the customer relationship for billing-related matters.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled before the renewal date. You may cancel at any time, and cancellation takes effect at the end of the current billing period.
- Taxes. Applicable taxes may apply and will be shown at checkout where required.
- Receipts & invoices. You will receive a receipt for your purchase.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, or infringe the rights of others;
- Generate or distribute illegal, infringing, harmful, abusive, hateful, or deceptive content;
- Attempt to gain unauthorized access to the Service or its systems;
- Engage in automated scraping, data mining, or excessive automated requests;
- Resell, sublicense, or commercially exploit the Service except as expressly permitted;
- Circumvent usage limits, token accounting, security measures, or access controls;
- Interfere with or disrupt the integrity or performance of the Service.
7. AI-Generated Content
The Service uses third-party AI models to generate outputs based on your inputs. AI-generated outputs may be inaccurate, incomplete, outdated, or otherwise unsuitable for your needs, and are provided on an “as is” basis. You are solely responsible for reviewing, verifying, and deciding how to use any outputs. As between you and Cobain AI, you retain rights to your inputs and to the outputs you generate, subject to the terms of the underlying AI providers. We do not guarantee that outputs are unique, original, or non-infringing, and similar outputs may be generated for other users.
8. Intellectual Property
The Service itself, including its software, design, branding, trademarks, and underlying technology, is owned by Cobain AI or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you to use the Service, no rights are transferred to you. You may not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law.
9. Third-Party Services
The Service relies on third-party providers, including our payment providers (Tripay, PayPal), hosting and database providers such as Supabase, and AI providers such as Google and Anthropic. Your use of these services may be subject to their respective terms and policies. We are not responsible for the acts or omissions of third-party providers.
10. Disclaimers & “As Is”
The Service and all outputs are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Cobain AI and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cobain AI and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your content or inputs, or your violation of these Terms or applicable law.
13. Suspension & Termination
We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Upon termination, your right to use the Service will cease, although certain provisions of these Terms will survive termination.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles. Subject to applicable mandatory consumer protection laws, any disputes arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts located in Indonesia.
15. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
